Tax Exemption Announced for Land Acquired for National Highway Projects
Relief for Landowners and Farmers
The Indian government has introduced a tax exemption for individuals receiving compensation for land acquired for national highway (NH) projects. This decision is aimed at easing the financial burden on numerous landowners and farmers impacted by land acquisitions.
The Union Ministry of Road Transport has confirmed that no Tax Deduction at Source (TDS) will be applied to such compensation payments. All agencies responsible for national highways are expected to adhere to this directive, ensuring that beneficiaries receive their full compensation amount without deductions.
Financial Overview of Land Acquisition
During the financial year 2025-26, the Indian government allocated approximately Rs 20,000 crore for land acquisitions, covering over 10,000 hectares intended for highway development across various regions. This significant investment highlights the government’s commitment to enhancing road infrastructure and connectivity.
A circular issued to national highway agencies, including the National Highways Authority of India (NHAI), outlined that compensation distributed under the National Highways Act will be considered exempt from income tax when determined in accordance with the land acquisition law established in 2013.
Legal References and Compliance
The Ministry’s directive refers to a previous circular from the Central Board of Direct Taxes (CBDT) dated October 25, 2016, along with Section 402 of the Income Tax Act of 2025. These references clarify that compensation payments made under the provisions of the land acquisition law of 2013 are not subject to income tax, despite the absence of explicit provisions on the matter.
This exemption is expected to provide financial relief to affected parties, allowing them to utilize the compensation received for their land without the concern of tax liabilities. The initiative underscores the government’s efforts to support landowners and facilitate the smoother execution of infrastructure projects across the country.
