Husband Seeks Court Direction for Wife’s Medical Examination to Establish Gender

A husband has filed a petition with the Delhi High Court, asking for the Delhi Police to conduct a medical examination of his wife at a Central Government hospital to ascertain her gender. The husband claims that his wife is a “transgender individual,” alleging that this information was concealed prior to their marriage.
In his petition, the husband states that this alleged concealment has inflicted mental trauma on him, hindered the consummation of their marriage, and resulted in various false legal actions against him. The plea was submitted by Advocate Abhishek Kumar Choudhary.
Interconnected Rights and Legal Implications
The plea acknowledges that issues surrounding an individual’s sex or gender identity are privately held matters. However, it stresses that within the framework of marriage, the rights of both parties are interconnected. It emphasizes the importance of maintaining a balance that respects the fundamental rights to life of both individuals, as guaranteed under Article 21 of the Constitution of India.
The petitioner argues for his fundamental right to a fair investigation and the determination of facts prior to being subjected to legal proceedings that are specifically designed for women. He avers that if his wife does not qualify as a “woman” under the definitions of relevant laws, he should not be liable to pay maintenance or be faced with allegations of domestic violence and dowry.
Previous Court Application Dismissed
Prior to this petition, the husband approached the trial court under Section 151 of the Code of Civil Procedure (CPC) to request the establishment of a medical board for the examination of his wife. However, the trial court dismissed his application for the medical examination.
