Yashwant Varma’s Resignation May Lead to Graft Investigation

Details of the Resignation

Justice Yashwant Varma’s resignation, announced last Friday, prevents him from having to defend his position in Parliament amid a proposed motion for his removal as a judge. This development may now allow authorities to investigate the origins of significant amounts of cash discovered at his official residence located in a high-security area of New Delhi.

The investigation could proceed, as Varma’s prior immunity as a high court judge has been lifted with his resignation. This could potentially implicate him under the Prevention of Corruption Act.

Eyewitness Accounts and Judicial Actions

Recent weeks saw Varma’s lawyers refuting speculation about his resignation, calling such claims mere “rumours.” However, it appears that the consistency of eyewitness testimonies, particularly during moments when Varma’s legal team questioned these accounts, may have influenced his decision to step down.

On March 14-15, the Delhi Police Commissioner informed the Chief Justice of the Delhi High Court, Justice D K Upadhyay, about the discovery of a large sum of money at Varma’s residence. This revelation followed a fire incident initiated by a call from the judge’s daughter that required response from fire and police personnel.

Impact on Judicial Practices

Justice D K Upadhyay subsequently notified the then Chief Justice of India, Sanjiv Khanna, which led to a series of rapid developments regarding alleged corruption within the judiciary. This incident reignited discussions regarding the Supreme Court collegium’s exclusive control over the appointment process for judges in high courts and the apex court.

On March 20, following the incident, the Supreme Court collegium, led by the Chief Justice of India, considered transferring Justice Varma back to the Allahabad High Court while also relieving him of his judicial duties. A report was requested from the Chief Justice of the Delhi High Court as part of this process.

Inquiry and Legislative Actions

After the Supreme Court collegium received the report from the Delhi High Court Chief Justice, a recommendation for Varma’s transfer was made. The Times of India was the first to report both the incident and the impending transfer of Justice Varma on March 22 of the previous year.

The issue escalated further when then Chief Justice Khanna formed an inquiry committee comprising Chief Justices from Punjab and Haryana, Himachal Pradesh, and a Justice from the Karnataka High Court. Following an extensive and detailed investigation, the committee issued a report on May 3, confirming the discovery of large sums of cash at Varma’s house, alongside puzzling circumstances surrounding its disappearance.

Current Status of Proceedings

In response, Speaker Om Birla of the Lok Sabha established a three-member committee to investigate the allegations against Justice Varma. This committee is chaired by the Supreme Court’s Justice Aravind Kumar and includes the Chief Justice of the Madras High Court and a senior advocate. Following the retirement of Justice Srivastava, he was replaced by the Chief Justice of the Bombay High Court, Shree Chandrashekhar.

The Lok Sabha’s office has made significant progress in compiling evidence against Justice Varma, largely based on the findings from the internal inquiry committee, and is nearing completion of the proceedings regarding the case.
